At Notamy we respect your privacy and are committed to protecting your personal information. This Privacy Policy explains how Notamy ("we," "us," or "our") collects, uses, and safeguards your data when you use the Notamy mobile application ("App").

By downloading, accessing, or using the App, you acknowledge that you have read and understood this Privacy Policy. If you do not agree, please discontinue the use of the App.

The App is intended exclusively for users aged 18 or above. We do not knowingly allow individuals under the age of 18 to use the App or create accounts.

Our services have optional features which, if used by you, require us to collect additional information to provide such features. You will be notified of such a collection, as appropriate. If you choose not to provide the information needed to use a feature, you will be unable to use the feature.

  1. Information We Collect: When you use the App, we may collect the following information:

  1. Data Provided Directly by the User:

    • Account Information: You must provide your mobile phone number to create a Notamy account. We do not require an email address or password to create or access your account. Your phone number is used solely for account creation, authentication, and security purposes and is never displayed to other users.

    • Profile information: Name, age, gender, and photos.

    • User biography and preferences.

    • Posts, messages, and other content you share on the App.

    • Interests and lifestyle information (optional).

Some profile information you choose to provide may reveal sensitive characteristics. By choosing to provide such information, you acknowledge that it may be processed in accordance with this Privacy Policy. You may remove or modify such information at any time through your profile settings.

  • If you use AI Features, we process any content you submit to the AI systems, including images, videos, and text prompts.

  1. Location Data: To enable proximity-based features, we collect your real-time location data. Location data enables important proximity-based and discovery features within the App.

We:

  • Primarily collect location data when the App is active for proximity-based discovery features. If you choose to share your location with another user through location-sharing or map-based features, location data may be processed in the background for the duration you select, subject to your explicit action and device permissions. Background location sharing stops automatically once the selected duration ends or when you disable the feature.

  • Allow you to control location sharing in settings.

  • Use location for discovery. Your precise location is never displayed to other users. Other users may only see approximate distance or proximity indicators (such as relative distance ranges), not your exact location.

  • Delete location history after 30 days.

We do not share your precise location with advertising partners. Advertisers only receive approximate information. We do not share or disclose your precise real-time location to any third parties.

  1. Device Information: IP address, device type, operating system, and usage data.

We do not access, upload, or process your mobile device contacts or address book.

AI Features: The App includes artificial intelligence features (“AI Features”) that generate, modify, or enhance images, videos, text, or other content based on the information you provide. All AI Features require payment and are provided through third-party artificial intelligence service providers (“AI Providers”). AI Features are optional and only available to users who choose to purchase them.

Data Processed by AI Features: When you use AI Features, we may process the following personal data:

  • Photos, videos, and other media you upload

  • Text prompts or descriptions you provide

  • Metadata embedded in your content (including approximate location)

  • Profile information (such as age and gender)

  • Device information and usage logs

  • Safety and moderation signals related to your use of AI Features

If you do not wish to provide this information, you will not be able to use AI Features.

  1. Use of AI Features: By using AI Features, you acknowledge and agree that content you submit, including images, videos, prompts, and related information, may be processed by third-party AI Providers as described in this Privacy Policy. If you choose not to provide the information necessary for AI processing, you will not be able to use AI Features. You may stop using AI Features at any time through the App settings or by discontinuing use of the relevant features. Discontinuation of AI Features will not affect the lawfulness of processing carried out prior to such discontinuation and will not entitle you to refunds for purchases already completed, except where required by applicable law.

  2. Third-Party AI Providers: To provide AI Features, we may transmit user inputs (such as images, videos, text prompts, and related metadata) to third-party artificial intelligence service providers. These providers process data in accordance with their own terms, privacy practices, and applicable legal obligations. We do not intentionally submit personal data to third-party AI providers for the purpose of training public AI models. However, certain providers may process submitted data for service improvement, safety, abuse prevention, or model development purposes in accordance with their own policies.

How AI-Related Data Is Used: We use data processed by AI Features to:

  • Generate content based on your inputs

  • Maintain the safety and integrity of AI systems

  • Detect and prevent misuse, fraud, or harmful conduct

  • Improve the performance and reliability of the App

  • Fulfil purchases and provide Paid AI Features

  • Create security logs for audit and compliance

AI Data Retention: AI-related data is retained according to the following rules:

  • Inputs (photos, videos, prompts): retained only as necessary to process your request and ensure safety.

  • AI-generated content: stored in your account until you delete it.

  • Logs and safety-related metadata: retained for up to 12 months for fraud prevention and security.

  • Data used for billing/payment: retained as required by law.

We do not store your underlying media solely for AI model training. We process only the minimum amount of personal data necessary to provide AI Features.

Automated Decision-Making: AI Features do not make decisions that produce legal or similarly significant effects about you. AI processing does not include automated profiling that produces significant effects as defined under applicable data protection laws. AI outputs are generated solely based on your inputs and remain under your control. AI Features are not intended to perform facial recognition, identity detection, or any biometric identification.

Restrictions on Uploading Third-Party Personal Data: You must not upload or submit photos, videos, or other content containing personal data of any third party without their lawful consent. This includes facial images, identification documents, or other sensitive personal information.

International Transfers: Data processed by AI Providers or other service providers may be transferred to and processed in countries outside your jurisdiction, including countries that may have different data protection laws than your country of residence. Where required by applicable law, we implement appropriate safeguards designed to protect personal data in connection with such transfers.

How We Use Your Information: We use your information to:

  • Discovery: Connect with nearby users based on location and preferences

  • Communication: Enable messaging and social interactions

  • AI Processing: To generate content you request through AI Features and ensure the safe and lawful operation of such features.

  • Safety: Verify accounts and prevent abuse.

  • Improvement: Enhance app features and user experience

  • Support: Provide customer service and technical support. Provide information about updates, features and services.

  • Advertising: We may display advertisements within the App. These advertisements may be based on your activity within the App, approximate location, or general interests. If you are an iOS user, we may request permission to track your activity across other companies’ apps and websites for advertising purposes using Apple’s App Tracking Transparency Framework. You may change your choice at any time in Settings>Privacy>Tracking.

  1. Sharing of Information: We do not sell your personal information. We may share your data with:

  • Service providers who help us operate the App.

  • AI Providers who process your inputs to provide AI Features. These providers process data primarily to provide the requested AI output and to ensure safety and abuse prevention.

  • Legal authorities if required by law.

  • Other users, in accordance with the features of the App (e.g., proximity data, posts, messages).

  • We may share limited information (such as device identifiers, approximate location, and App activity) with third party advertising partners to show ads, measure performance and prevent fraud.

We implement encryption and other industry-standard security measures designed to protect communications transmitted through the App. Messaging features use end-to-end encryption technologies, where applicable.

Where end-to-end encryption is used, message content is encrypted to protect communications between users. Notamy does not routinely access, monitor, or review encrypted message content in the ordinary course of providing the Services.

Notamy may process limited communications metadata and related information necessary to operate, secure, and improve the Services, including message delivery information, timestamps, account identifiers, device information, security logs, and abuse reports voluntarily submitted by users.

  1. Data Retention: We retain your information for as long as necessary to provide the service and comply with legal obligations. You may request deletion of your account and data.

Active accounts: Data retained while account is active.

Deleted accounts: Most data deleted within 30 days.

Legal requirements: We may retain limited log data for security, fraud prevention, and legal compliance for up to 12 months.

Messages: Automatically deleted after 1 year of inactivity.

  1. Purposes and legal basis for processing:

We rely on the following legal bases for processing personal data:

o Contract: to provide and operate the core features of the App, including account creation, messaging, proximity-based discovery, content sharing, purchases, and AI Features requested by users.

o Consent: for optional profile information that may reveal sensitive characteristics, personalized advertising, certain optional permissions, and other processing activities where consent is required by applicable law.

o Legitimate Interests: to maintain the safety, security, integrity, and performance of the App, prevent fraud and abuse, improve our services and AI Features, enforce our Terms, and support the operation of the Services.

o Legal Obligations: where processing is necessary to comply with applicable laws, regulations, legal processes, or lawful requests from public authorities.

  1. Data Security:

We implement industry-standard technical and organizational measures to protect your data against unauthorized access, alteration, or disclosure. These include:

  • Encryption and other industry-standard safeguards designed to protect communications and user data

  • Secure data transmission (HTTPS/TLS)

  • Regular security audits and updates

  • Restricted employee access to personal data

AI processing may occur on servers operated by our AI Providers. We take reasonable steps to use AI Providers that maintain appropriate technical and organizational security measures, but their processing is also governed by their own terms, privacy policies, and security practices.

While we take reasonable steps to safeguard your information, we cannot guarantee that the App will be completely secure or free from bugs, errors, or vulnerabilities. Transmission of data over the internet carries inherent risks, and you acknowledge that you provide information at your own risk.

We apply data minimization principles and only collect the data that is necessary to provide our services.

  1. Your Rights: Depending on your jurisdiction, you may have rights to:

  • Access personal data we hold about you.

  • Request correction or deletion of your data.

  • Object to data processing.

  • Withdraw consent.

  • Export your data to another service.

  • Right to lodge a complaint with your local data protection authority.

  • If applicable, you may withdraw your consent to personalized advertising at any time by adjusting device settings or, where available, within the App’s privacy settings. You will still see ads, but they will not be personalized.

To exercise these rights, you may contact legal@notamy.app . We may need to verify your identity before responding.

  1. International Users: Notamy operates globally. By using Notamy, you acknowledge that your data may be transferred to and processed in countries other than your own.

  2. Governing Law: This Privacy Policy is governed by the laws of Malta.

  3. Dispute Resolution and Arbitration: To the fullest extent permitted by applicable law, any dispute, controversy, or claim arising out of or relating to this Privacy Policy or your use of the App shall be resolved through binding arbitration. The arbitration will be conducted by a single arbitrator in accordance with the UNCITRAL Arbitration Rules in effect at the time of the dispute. The arbitration shall take place remotely or in a mutually agreed location and shall be conducted in the English language, unless otherwise agreed. By using the App, you waive the right to a trial by jury or to participate in a class action lawsuit. Notwithstanding the foregoing, if you are a consumer residing in the European Union or in any jurisdiction where mandatory consumer protection laws grant you the right to bring disputes before local courts or prohibit mandatory arbitration, this arbitration clause shall not apply to the extent required by such laws, and you may exercise your rights before the competent courts of your place of residence.

  4. User Responsibilities: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We encourage you to use strong passwords and to log out after using the App on shared devices.

  5. Third-Party Services: Notamy may contain links to or integrations with third-party services, websites, or applications. We are not responsible for the privacy practices or content of these third parties. Please note that our Privacy Policy applies only to the use of our services. When you use third-party products or services, their terms and privacy policies will govern your use of those products or services. We encourage you to read their privacy policies before providing any information.

  6. Changes to This Privacy Policy: We may update this Privacy Policy from time to time. We will notify you of significant changes. Continued use of the App constitutes acceptance of the revised policy.
