Notamy Terms and Conditions of Use

Welcome to Notamy! These Terms and Conditions ("Terms") govern your access to and use of the Notamy mobile application (the "App" or “Notamy”).

About Our Services

Notamy provides an AI-powered social and creative platform that enables users to generate, enhance, share, and discover visual and interactive content, including AI-generated or AI-enhanced images, videos, and other media. The Services may include social discovery features, proximity-based interactions, public posting, messaging tools, personalized recommendations, and other interactive functionalities.

For the purposes of these Terms, “Services” includes all features, functionality, content, software, AI Features, technologies, and services made available through the App.

Certain features within the Services use artificial intelligence technologies provided by third-party providers to generate, modify, enhance, process, recommend, or analyze content (“AI Features”). AI-generated outputs may be inaccurate, incomplete, inconsistent, or unsuitable for particular purposes. We continually work to improve the Services, but we do not guarantee any specific outcomes, visibility, engagement, or results from the use of the App or AI Features.

Notamy facilitates social interaction and content sharing between users but does not control, endorse, or assume responsibility for user behavior, communications, or interactions, whether they occur within or outside the App. You are solely responsible for your interactions with other users and for the content you create, share, or publish through the Services.

Certain AI Features and premium functionalities may require payment through in-app purchases provided by the applicable platform operator.

By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the App.

Our Terms and Policies. You must use the App according to our Terms and posted policies. If you violate our Terms or policies, we may take action with respect to your account, including disabling or suspending your account and, if we do, you agree not to create another account without our permission. Disabling or suspending your account will be in accordance with the "Termination" section below.
Eligibility: You must be at least 18 years old to use Notamy. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.
Registration: You must register for our Services using accurate information, provide your current mobile phone number, and, if you change it, create a new account. You agree to receive text messages (from us or our third-party providers) with codes to register for our Services. You are solely responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
User Conduct: You must access and use the App only for legal, authorized, and acceptable purposes. You agree not to:

Use the App for any unlawful or prohibited purpose.
Harass, abuse, or harm another person.
Post or share content that is offensive, discriminatory, defamatory or violates any third-party rights.
Impersonate any person or entity.
Publish falsehoods, misrepresentations, or misleading statements.
Upload, generate, share, or distribute synthetic, AI-generated, or manipulated media intended to impersonate, deceive, exploit, harass, or mislead others.
Upload or generate content using the likeness, voice, image, or identity of another person without appropriate authorization or lawful basis.
Upload or distribute sexually explicit, exploitative, violent, abusive, or unlawful AI-generated content.
Upload content that infringes third-party intellectual property rights, including copyrighted music, videos, trademarks, likeness rights, publicity rights, or privacy rights.
Use the App to create misleading deepfakes, deceptive synthetic media, or manipulated content intended to cause harm or confusion.
Engage in spam, coordinated manipulation, fake engagement, or automated activity intended to manipulate the visibility or popularity of content.

We reserve the right to suspend or terminate your account for violations of these Terms.

Harm to Our App or Users

To protect our App, our systems, and all our users, you agree not to do (or assist others to do) any of the following:

Abuse our Services: You must not access, use, copy, adapt, modify, distribute, or exploit our services in any manner that is not permitted or that could cause harm, burden, or impairment to us, our services, or our users.
Tamper with our code: You must not attempt to reverse engineer, alter, modify, create new versions of, decompile, or extract code from our App.
Introduce Malware: You must not send, store, or transmit viruses or any other harmful computer code through or onto our services.
Unauthorized Access: You must not attempt to gain unauthorized access to our App or systems.
Interfere with Performance: You must not interfere with or disrupt the safety, security, confidentiality, integrity, availability, or performance of our services.
Automated Accounts: You must not create accounts for our services through unauthorized or automated means.
Collect User Data Improperly: You must not collect information of or about our users in any impermissible or unauthorized manner.
Commercialize Our Services: You must not sell, resell, rent, or charge for our services or data obtained from us or our services in an unauthorized manner.
Unauthorized Distribution: You must not distribute or make our services available over a network where they could be used by multiple devices at the same time, except as authorized through tools we have expressly provided via our services.
Imitate Our Services: You must not create software or APIs that function substantially the same as our services and offer them for use by third parties in an unauthorized manner.
Misuse Reporting Tools: You must not misuse any reporting channels, such as by submitting fraudulent or groundless reports or appeals.

Devices And Software. You must provide certain devices, software, and data connections to use our services, which we otherwise do not supply. In order to use our services, you consent to manually or automatically download and install updates to our services. You also consent to our sending you notifications via the App from time to time, as necessary to provide our services to you.
Location Data and Proximity Features: Notamy uses location data to provide proximity-based discovery, local content suggestions, and other location-related features within the Services. By using the App, you acknowledge and consent to the processing of location data as described in our Privacy Policy.

You may disable location permissions through your device settings at any time; however, certain features of the App may become unavailable or limited without access to location data.

Notamy does not verify the identity or conduct of users and is not responsible for interactions between users, whether online or offline. You are solely responsible for your interactions with other users through the Services.

User-Generated Content: Users may upload, generate, modify, publish, submit, transmit, or share content through the Services, including AI-generated or AI-enhanced images, videos, audio, text, avatars, prompts, metadata, and other materials (“User Content”).

You retain ownership of your User Content to the extent permitted by applicable law. However, by creating, uploading, generating, publishing, submitting, transmitting, or sharing User Content through the App, you grant Notamy a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, adapt, modify, distribute, publicly display, publicly perform, create derivative works from, and otherwise use such User Content for the purposes of:

(a) operating, providing, maintaining, securing, and improving the Services;

(b) developing, testing, improving, and supporting AI Features and related technologies;

(d) promoting and marketing the Services; and

(e) complying with legal obligations and enforcing these Terms.

You acknowledge and agree that User Content generated through AI Features may constitute synthetic or artificially generated media and may be publicly visible to other users depending on your account settings and use of the Services.

You represent and warrant that:

(a) you own or have all necessary rights, permissions, licenses, consents, and lawful bases to use and share your User Content;

(b) your User Content does not infringe or violate any third-party rights, including intellectual property rights, privacy rights, publicity rights, likeness rights, personality rights, or contractual rights; and

Notamy does not guarantee the confidentiality or exclusivity of User Content shared publicly through the Services.

Notamy reserves the right, but not the obligation, to review, monitor, remove, restrict, disable access to, or refuse User Content that is publicly available, reported by users, or otherwise accessible to Notamy where reasonably necessary to enforce these Terms, comply with applicable law, protect users, maintain platform integrity, or comply with platform or third-party provider requirements.

AI Features and AI-Generated Content: The Services may include artificial intelligence features that generate, modify, enhance, recommend, process, or analyze content. AI Features may rely on third-party artificial intelligence models, systems, infrastructure, and service providers ("Third-Party AI Providers").

AI-generated outputs may be inaccurate, incomplete, inconsistent, offensive, unavailable, misleading, or unsuitable for a particular purpose. AI-generated outputs are probabilistic in nature and may unintentionally resemble existing works, voices, images, trademarks, individuals, or other real-world elements.

You are solely responsible for reviewing and evaluating any AI-generated output before using, publishing, sharing, relying on, or distributing it. You should not rely on AI-generated outputs as a substitute for professional advice, factual verification, or independent judgment.

Notamy does not guarantee the accuracy, reliability, legality, originality, availability, or suitability of AI-generated outputs or AI Features. To the fullest extent permitted by applicable law, Notamy disclaims liability arising from:

(a) errors, inaccuracies, hallucinations, biases, or defects in AI-generated outputs;

(b) interruptions, failures, or unavailability of AI Features or Third-Party AI Providers;

(d) modifications, restrictions, suspension, or discontinuation of AI Features.

Certain AI Features may require the processing of User Content, prompts, images, videos, audio, metadata, and related information by Third-Party AI Providers for the purpose of generating outputs, improving safety systems, preventing abuse, and operating the AI Features. By using AI Features, you acknowledge and consent to such processing as described in our Privacy Policy.

Notamy does not own the underlying artificial intelligence models, algorithms, systems, or technologies used to provide AI Features. All rights relating to such systems remain with the applicable Third-Party AI Providers.

Notamy may modify, restrict, suspend, or discontinue AI Features at any time where reasonably necessary to maintain platform integrity, comply with applicable law, address safety concerns, comply with platform or Third-Party AI Provider requirements, or improve the Services.

Third-Party AI Providers: The AI Features rely on third-party artificial intelligence systems, models, and processing services. Notamy does not control, operate, or guarantee the functionality, accuracy, performance, availability, or output of these Third-Party AI Providers. Your inputs and AI-Generated Content may be processed by such providers primarily for the purpose of generating outputs and ensuring compliance with safety and abuse-prevention requirements. Your use of AI Features constitutes your agreement to the terms, privacy practices, and usage policies of the relevant Third-Party AI Providers, as applicable.
Paid AI Features: All AI Features offered in the App require payment. You will not be able to access or use AI Features unless you purchase the applicable in-app product, subscription, or usage credits (“Paid AI Features”). Paid AI Features will be clearly identified in the App before you make any purchase.
In-App Purchases: Payment for Paid AI Features must be made exclusively through the in-app purchase systems provided by the Apple App Store or any other platform operator (“Platform Providers”). Notamy does not process or store your payment information, and all such transactions are governed by the terms, conditions, and refund policies of the applicable Platform Provider.
Pricing and Changes: Prices for Paid AI Features are displayed in your local currency and may change from time to time. Price changes will not affect any purchases already completed. Notamy may offer Paid AI Features as one-time purchases, credits, usage limits, or subscriptions.
No Refunds: Except where required by applicable law, purchases of Paid AI Features and credits are non-refundable. Refund requests must be submitted directly to the Platform Provider.
Failure to Pay: If a payment is reversed, refunded, or charged back, Notamy may:
(a) suspend or disable access to Paid AI Features;
(b) remove AI-Generated Content created using unpaid features;
(c) terminate your account in cases of repeated or fraudulent chargebacks.
Right to Modify Paid AI Features: Notamy may modify, limit, suspend, or discontinue any Paid AI Feature.
Prohibited Uses of AI Features: You agree not to use AI Features to generate, upload, share, or attempt to create any content that:
(a) depicts nudity or sexually explicit material;
(b) exploits, sexualizes, endangers, or unlawfully depicts minors;
(c) is unlawful, abusive, harassing, hateful, discriminatory, or violent;
(d) falsely impersonates, misrepresents, or deceptively imitates any real person or entity in a manner that is unlawful, fraudulent, misleading, exploitative, or intended to deceive others;
(e) infringes any copyright, trademark, privacy, publicity, or other third-party rights;
(f) includes sensitive personal information of others (e.g., identification documents, medical information, financial information);
(g) circumvents or attempts to circumvent safety filters or content restrictions imposed by Notamy or its AI providers.

You must not use AI Features to identify or attempt to identify any individual, including matching faces, detecting identities, or re-identifying persons from images or videos. You must not upload or submit content that includes personal data of any third party without their lawful consent, including images, videos, identification documents, biometric data, or any sensitive personal information. You must not use AI Features to infer or attempt to infer sensitive attributes of any individual, including but not limited to race, ethnicity, religion, political opinions, health, disability, or sexual orientation. Notamy may delete AI-Generated Content and suspend or terminate accounts that violate these prohibitions.

Moderation and Reporting: AI-Generated Content is subject to the same moderation rules as other User-Generated Content. We may use automated and human moderation measures to detect and address harmful or prohibited AI-Generated Content. Users may report AI-Generated Content through the App’s reporting tools. Notamy may remove or restrict content at its discretion.

You agree to indemnify Notamy against any claim arising from your use or misuse of the AI Features.

Availability and Changes to AI Features: Notamy may modify, limit, suspend, or discontinue AI Features at any time, including to comply with safety standards, legal requirements, or platform rules (such as Apple App Store guidelines). Some AI Features may not be available in all jurisdictions. Notamy may also immediately disable or restrict any AI Feature to address safety risks, regulatory requirements, security concerns, or failures of Third-Party AI Providers.

Privacy: We collect and process personal information in accordance with our Privacy Policy. Please review it carefully to understand how we handle your data.
Notamy’s Rights. We own all copyrights, trademarks, domains, logos, trade dress, trade secrets, patents, and other intellectual property rights associated with our App. You may not use our copyrights, trademarks (or any similar marks), domains, logos, trade dress, trade secrets, patents, and other intellectual property rights unless you have our express permission. For clarity, Notamy does not own the artificial intelligence models or technologies used to provide the AI Features. All rights in such models, technologies, and systems remain with the respective Third-Party AI Providers.
Safety and Disclaimers: We strive to create a safe environment, but we cannot guarantee the identity of users. You are solely responsible for your interactions with others on Notamy.

We provide the App on an "as is" and "as available" basis without warranties of any kind, either express or implied and do not accept any responsibility for bugs, errors, or technical issues that may occur during use of the App. This includes but is not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from the course of dealing or usage of trade.

Notamy does not warrant that the App will be uninterrupted, error-free, secure, free of viruses, bugs, technical glitches, or other harmful components. We do not guarantee that any content or information you obtain through the App will be accurate or reliable.

You assume all risks associated with your use of the App, including reliance on any content, interactions with other users, and any harm that may arise from such interactions.

The AI Features are provided on an “as is” and “as available” basis and depend on the availability and performance of Third-Party AI Providers. Notamy disclaims all liability arising from: (a) the operation or failure of third-party AI systems; (b) any errors, inaccuracies, biases, or defects in AI-generated outputs; and (c) any decisions or actions taken by you or any third party in reliance on AI-generated content. You acknowledge that Notamy does not control and is not responsible for the behavior or output of third-party AI systems.

Limitation of Liability: To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from or in connection with:

Your access to or use of the App.
Any conduct or content of any user or third party.
Any content obtained from the App.
Unauthorized access, use, or alteration of your transmissions or content.

Our aggregate liability relating to, arising out of, or in any way in connection with our terms, us, or our services will not exceed the greater of one hundred United States dollars (USD 100) or the amount you have paid us in the past twelve months. This limitation applies regardless of the legal theory, whether based on warranty, contract, tort, or any other legal ground, and even if we have been advised of the possibility of such damages. This limitation of liability applies to all Paid AI Features, in-app purchases, and any AI-Generated Content.

Termination: We reserve the right to suspend or terminate your access to the App at our sole discretion, with or without notice.
Indemnification: You agree to indemnify, defend, and hold harmless Notamy, its creator, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with:

Your access to or use of the App.
Your violation of these Terms.
Any misrepresentation made by you.
Your violation of any rights of another, including but not limited to intellectual property rights and privacy rights.

Governing Law: These Terms are governed by the laws of Malta.
Dispute Resolution and Arbitration: To the fullest extent permitted by applicable law, any dispute, controversy, or claim arising out of or relating to these Terms and Conditions or your use of the App shall be resolved through binding arbitration. The arbitration will be conducted by a single arbitrator in accordance with the UNCITRAL Arbitration Rules in effect at the time of the dispute. The arbitration shall take place remotely or in a mutually agreed location and shall be conducted in the English language, unless otherwise agreed. By using the App, you waive the right to a trial by jury or to participate in a class action lawsuit. Notwithstanding the foregoing, if you are a consumer residing in the European Union or in any jurisdiction where mandatory consumer protection laws grant you the right to bring disputes before local courts or prohibit mandatory arbitration, this arbitration clause shall not apply to the extent required by such laws, and you may exercise your rights before the competent courts of your place of residence.
Time Limit to Bring a Claim or Dispute: To the fullest extent permitted by applicable law, you and Notamy agree that any claim or dispute (except for any claim relating to intellectual property rights or breach of confidentiality) must be filed within one (1) year after the date the claim or dispute first arose. If a claim or dispute is not filed within this time frame, it is permanently barred. This limitation period applies to any form of legal proceeding, including arbitration or court actions, and regardless of the nature of the claim or dispute.
Changes to Terms: We may modify these Terms from time to time. We will notify users of significant changes. Continued use of the App constitutes acceptance of the updated Terms. Changes to pricing or Paid AI Features will be communicated in the App before taking effect.
